1. About WhimsyStuff
First things first: the potions are for decoration purposes only. Do NOT drink them. They are superglued shut, so they are very difficult to open accidentally. If you do happen to open them, do NOT consume them in any way. They may be toxic. Please keep away from children and pets, as the products may contain small objects which can be a choking hazard. I will not be responsible for any accidents if consumed.
The WhimsyStuff company is located in Skövde, Sweden. The shipping address is Östergatan 47a, 54136 Skövde.
Whimsy Stuff is a privately owned business (enskild näringsverksamhet), with org. nr. 921110-1168. VAT identification number (momsregistreringsnummer) is SE921110116801.

Please include your contact information and order number (if applicable) in the message, and I will reply to you as soon as I can. You can send your message in English or Swedish.

2. Order
When you have completed your order, you will get an order confirmation to your e-mail. In this confirmation e-mail you will find information about the product(s) you ordered, prices, billing address, and delivery address. If you find any errors in this e-mail, please send me an e-mail immediately to whimsystuffcreations@gmail.com, including your contact information and order number. Please allow me 5 days for processing time, before I send the order out. It is your responsibility to provide accurate purchase and account information.
3. Shipping
WhimsyStuff uses PostNord for shipping/delivery. The estimated delivery time differs from country to country, and differs between the chosen shipping methods. In Sweden, the estimated delivery time is about 5 weekdays. Please read the ’Payment & Delivery’ tab on the website for more detailed information about shipping. If there are any delays (without me telling you that this will occur), you can contact me on e-mail whimsystuffcreations@gmail.com.
WhimsyStuff is not responsible for any negligence by the shipping company. If you want the order shipped with PostNord’s REK shipping method (please visit postnord.se for more information) or trackable shipping method, then you choose that delivery option. If the package is lost during transit, please contact PostNord (provided that you chose and payed for the REK or the trackable shipping method), providing them with your contact information and tracking information.
Commissions with personal names and/or other specific personal attributes cannot be returned. The only exceptions are if the potions are in the wrong size, have misspelled names/words, wrong colors and so on, than what we agreed on.
I am not responsible for any delays due to customs. I am not responsible for any customs taxes and import taxes that may arise. I cannot guarantee that the package will be delivered at the estimated time, but I will do my very best to meet the expectations. Should I notice that the shipping time will be a lot longer than the estimated delivery time, I will send you an e-mail. I recommend using the trackable shipping method.
5. Right of withdrawal
If you buy products from my website, you as a costumer have a 14 days withdrawal period that starts when you receive the package. Information about this right of withdrawal has been collected from Konsumentverket’s website (konsumentverket.se).
5.1 If you want to use your right of withdrawal
You have to notify me of your withdrawal within 14 days, but you do not need to tell me the reason why. You do this by sending me an e-mail (whimsystuffcreations@gmail.com), or by using the ’Contact’ tab on my website (whimsystuff.com). In your message, please include your name, address, order number, and clearly include which products you want to return. When you have sent me the withdrawal message, you have 14 days to send the items back to me. You are responsible for the shipping fees and the condition of the products when returning them. The products should be well packaged and in the original packaging. If the products are not in they’re original condition, the loss in value will be deducted from the refund. If this is the case, I will send you an e-mail. The refund will be processed at the latest 14 days from the day that I got notified of the withdrawal, I will however try to refund you as fast as I can (using the same payment method as you used, as long as we do not agree on something else). I cannot refund you for the shipping you used when ordering the product (as the shipping and delivery) has already been carried out).
5.2 The right of withdrawal does not apply:
When you ordered a commission with personal attributes. This could mean that the potion label contains a name, or have very specific attributes that I cannot resell.
6. Complaints & defects
I examine each product before I send them to you. If the products have any defects or are damaged in its packaging when it arrives to you, I will try to fix the problem for you without any additional costs. You have to contact me on e-mail (whimsystuffcreations@gmail.com) for an approval before you send the damaged product back to me.
6.1 How do you send a damaged product back?
If there’s any flaws or defects when you open the package, the first step is to send me an e-mail (whimsystuffcreations@gmail.com). Please include your name, adress, order number, a description of the flaws, as well as pictures of the defects. I cannot refund you if you do not include pictures. I will reply to you as soon as possible, and we can figure out a solution. If we cannot come to a conclusion or if I cannot deliver a new product, you will be refunded for the damaged product. The next step for you is to send the damaged product back to me (if it has minimal flaws, otherwise you do not have to send it back to me). You will have to pay for the shipping fees (you are free to use the cheapest delivery option). I reserve the right to deny this whole process, if it shows that the product is not inaccurate by the rules of ’Konsumentskyddslagstiftningen’ (a Swedish law that protects costumers and companies). I will follow the guidelines provided by ’Allmänna Reklamationsnämnden’ (please see art.se for more information).
7. Limitation of liability

I will not be responsible for any accidents if consumed. If the potions breaks by, for example, falling off your bookshelf onto the floor, the contents of the bottle may stain your floor. I will not be responsible for any damages caused by the potions/products. I will not be responsible for any indirect damages that can arise due to the products. I will not be responsible for any delays/damages due to circumstances that are outside of the company’s area of responsibility (Force Majeure). Examples of these kinds of circumstances includes, but are not limited to, fire, war, and authority decisions. I will not be responsible for any changes on the products that has been changed by delivery agencies and other factors outside of my control.
8. Product information & liability
I reserve the right for any typographical errors, inaccuracies, and the like on this website, and also if the products goes out of stock before you can pay for the order. I cannot guarantee that the pictures and videos on this website will show the products true nature, as some colors (for example) can be different due to the photo quality, photo resolution, and different screens. I will try my best to showcase the products as they are in real life. I cannot guarantee that your monitor’s display will show the colors accurately. It is your responsibility to check this page from time to time for any changes. You are not allowed to use my products in illegal and unauthorized purposes. I reserve the right to refuse service. I reserve the right to discontinue products at any time. The product descriptions or prices are subject to change without notice. Please read through the descriptions thoroughly. I cannot guarantee that my products will meet your expectations. I cannot guarantee that your use of my Service will be error-free, timely, or uninterrupted. I will however try my very best! By shopping at WhimsyStuff, you agree that your use (or your inability to use) of the Service is at your own risk and discretion.
9. Information about Cookies
According to the law of electronic information, visitors on a website has to get information about their privacy purpose and cookies. The cookies are used to follow a user’s Internet use. Cookies are small text file that the websites you visit requests to save on your computer to get access to different functions. 10. Personal data
By shopping at WhimsyStuff, you accept our data protection policy and my processing of your personal data. I care about your personal integrity and do not collect any unnecessary information that we do not need in the processing of the order. I do not sell or pass on any information to a third party without legal basis (please see 10.4.1 and 10.4.2 for more information about your personal data when it comes to the delivery company and the payment provider). WhimsyStuff is responsible for the usage of your personal data that you left us as a customer. Your personal data is used by me to process your order. The information down below is a summary of how we use your personal data according to ’Integritetsskyddsmyndigheten’ (please see imy.se for more information).
10.1 What is personal data?
Personal data is the information that directly or indirectly can be traced to a physical person.
10.2 Which personal data do I store?
To be able to process your order and to answer any questions you may have (customer service), I will store your name, address, phone number, e-mail address, ip-address, and purchase history. Your personal data is stored as long as we have a legal basis to process your data, for example, I may need to store your personal data if it is required in the accounting obligation specified in the Accounting Act.
10.3 Legal basis
When you buy products from me, your personal data is collected, as a way to process your order correctly.
10.4 What data is shared and to what purpose?
10.4.1 Payment provider
When you are paying for your order, personal data is shared with my payment provider. That which is shared and stored is your name, address, e-mail address, and phone number. If you choose the invoice option, your social security number is also stored at the payment provider. The data is stored to be able to carry through the order, and also to protect both parties from scams and fraud. The payment providers I use on WhimsyStuff.com are Klarna and PayPal.
10.4.2 Delivery company
To be able to deliver your orders and conclude our business deal, I have to share some specific personal data with the delivery company. That which is shared and stored is your name and address for delivery. Email and/or phone number could also be shared with the delivery company for delivery notification. The delivery company I use on WhimsyStuff.com is PostNord.
10.5 The right to excerpt personal data
You have the right to get an excerpt of your personal data that is stored by WhimsyStuff. This excerpt will be delivered electronically in a readable format. Please send me an e-mail to get this excerpt to whimsystuffcreations@gmail.com.
10.6 The right to fix data errors
You have the right to ask me to update and fix any errors in your personal data that is stored. Please send me an e-mail to whimsystuffcreations@gmail.com.
10.7 The right to be forgotten
You have the right to have your personal data deleted at any time. There are few circumstances where I cannot legally delete some information, for example, if the personal data is required in the the accounting obligation specified in the Accounting Act. Please send me an e-mail to whimsystuffcreations@gmail.com.
10.8 Data protection
WhimsyStuff is responsible for collecting and storing your personal data in the website, and to make sure that the rules and laws are followed.
10.9 How I protect your data
I use SSL certificate on my website to create a safe environment. The data between the web browser and the server is encrypted. I use STRATO AG for my website, please see strato.se for more information. They are based in Europe, and belongs to IONOS Group SE.
11. Changes to the Terms & Conditions
I reserve the right to change and update the terms and conditions at any time without notice. The changes of the terms and conditions will be published online on the website. The changed terms and conditions are considered accepted when you visit the website and when you are placing an order from the website. It is your responsibility to check this page from time to time for any changes.
12. Disputes
On occasion that a dispute cannot be resolved between the customer and myself, you as a customer can turn to ’Allmänna Reklamationsnämnden’ (arn.se) for help. If you are based in another country in the EU, you can turn to ’EU kommissionen’ (https://commission.europa.eu/index_sv), who can help meddle in the dispute.
On occasion that a dispute occurs, I will follow ARN’s (arn.se) guidelines and decisions.
Disputes regarding the interpretation or application of these general terms and conditions shall be interpreted in accordance with Swedish Law.
